A man Tenneesee could spend up to a year in prison after he was convicted of assault for punching a McDonald's employee in the face for giving him a sundae with hot fudge on the bottom instead of the top (like as it should to be, thank you very much).
The incident occurred in February 2010, when James Wilson says he was visiting a McDonald's for lunch.
"The food seemed to be right, but the dessert, which had the chocolate on the bottom," Wilson told the jury of eight women and four men in criminal court, Knox County. "Hot fudge should be at the top. It hangs when you get the fondant at the bottom of it. I asked them to do. "
Wilson has a point. Who eats fudge sundaes ... with the fondant at the bottom freaking?!? It just doesn't make sense.
But the store's assistant manager, Brad Skelton, didn't see it that way, and refused to make Wilson sundae another, with the fondant in place on top.
Skelton also refused to give Wilson a discount of $ 0.10, which would correspond to the price of a normal ice cream, and a verbal altercation ensued.
Skelton eventually gave Wilson back in the dollar, and how Wilson aimed towards the exit, Skelton darted toward a door on the side that faces out, the Knoxville News Sentinel reported.
"I just wanted to make sure he actually (left)," said Skelton. "I took two more steps out the door, and hit me in the face".
Wilson claimed that Skelton "loaded" on him and called him a racial slur and claimed that he was "acting in self-defence" when he punched Skelton in the face.
But the jury not to buy Wilson's argument of self-defence and he pleaded guilty to misdemeanor assault and disorderly conduct.
He was fined $ 1,050 and now wait a September 27 hearing where he could possibly be sentenced to 364 days in prison.
